Why does Tresorit need new Terms of Service?
We are continuously improving our services to meet our customers’ needs. From time to time, these improvements also affect the legal documents based on which we offer our services. So, in order to reflect our growth, we’re updating our Terms of Service. If you register to Tresorit after 19 June 2019, the updated Terms will apply to you. If you have registered to the Service before this date, the updated Terms of Service will become effective once you accept them, but no later than 30 July 2019.
Because of the number of the relevant changes, we decided that it is time to refresh the whole agreement. We hope that it is now easier to follow and understand. That said, please do not hesitate to contact us if you have any questions at email@example.com.
There are a few reasons why these updates to our Terms of Service were needed.
First, as we have developed our business, we’re facing different business needs. Based on customer requests, we understand that it is crucial for our business clients that they have clear control over the business data that they store with us. We responded to these needs by adding new control features and policies to our product recently. We believe that it is also important to clarify the ownership and control of such company data in our service agreement, so that our customers and their users have a clear understanding on these issues.
Based our clients’ feedback, we understand that business continuity and the possibility to recover data is also fundamental for most of our clients. We made certain amendments to reflect these needs so that for example, the subscription owner’s rights can be transferred within an organization.
Because of certain changes in our business model, in particular because of new distribution and partner channels or potential new payment methods, we also needed to add new clauses to regulate these new scenarios and to make clear our relationship with our clients in those cases.
What has changed?
Here's a quick summary of what's changed:
- The updated Terms of Service cover new features and products, such as new policies, new activity dashboards and Tresorit Send.
- Many of our users access Tresorit through their organizations who have control over the users' accounts or how they use our services. The updated Terms clarify the relationship between subscription owners, users and Tresorit. The goal is to help subscription owners understand what information is in their control, and what is under the control of their assigned users.
- To make our pricing more transparent and to be able to better serve users’ needs, we’re improving the way payments are handled. Don’t worry, this doesn’t change the amount you pay.
- Our aim was to make the Terms of Service as user-friendly as possible, so we used plain language and made navigating the text simpler.
What has not changed?
Nothing fundamental has changed around Tresorit’s services. We continue to store your data securely with client-side encryption. Accordingly, your security and our responsibilities have not changed. This is also true with respect to your payment obligations: The Terms of Service don’t change the amount you pay.
While now we set out the list of acceptable and unacceptable conduct for our Services in a separate document called “Acceptable Use Policy”, your obligations remain the same.
The “Legal Eagles” in your team will probably learn more about disclaimers, liability and indemnity clauses. The have also remained materially the same.
What can be expected?
The updated Terms of Service have been released on 19 June, and they are now available on the Tresorit website. If you are a new customer, you must accept the new terms when signing up to our service and the new terms will apply to you.
Our existing users will receive email and in-app notifications about the updated Terms of Service that they can accept from the email directly or within the Tresorit app.
How can I accept the Terms of Service?
Review the Terms of Service and click “accept” in either the email or the in-app notification. You only have to do it once.
Please note that the Terms of Service is a legally binding agreement between you and Tresorit, so make sure you read it carefully.
