Why is Tresorit’s service subject to restrictive measures regarding Russia and Belarus?
In response to the Russia-Ukraine war, the European Union imposed restrictions on services and products provided to Russian and Belarusian individuals and entities and to the territory of Russia and Belarus. These restrictions were introduced by the Council Regulation (EU) 2022/328 of 25 February 2022 and Council Regulation (EU) 2022/355 of 2 March 2022. The aforementioned EU-regulations prohibit providing several products and services, among others mass market encryption software, that might contribute to Russia’s or Belarus’ military and technological enhancement, or the development of the defense and security sector to any natural or legal person, entity, or body in Russia or Belarus or for use in Russia or Belarus. Based on Regulation (EU) No 2021/821, Tresorit’s Service qualifies as a mass market encryption software, therefore Tresorit applies these restrictive measures.
Are there any exceptions to the restrictions?
The regulations list some exceptions, in which cases Services can be provided to Russian / Belarus individuals / entities / to the territory of Russia / Belarus. All the exceptions are in connection with the intended use of the Services. We – as a service provider of end-to-end encryption software – are not able to examine for what aims our Services are used by our Customers / Users, and we cannot take the legal risk of being not compliant with the legal provisions. Besides, as a company working towards empowering people to secure their data and protecting the right to privacy as a human right, at Tresorit we strongly condemn any military actions that risk civilians’ right to safety and may violate international humanitarian law. With the suspension of our services, we wish to ensure that our services will not be used for threatening human rights.
Why has Tresorit suspended its services instead of termination?
Based on the regulations, only the provision of service is prohibited, service providers are not obliged to terminate the existing agreements. Based on our Terms of Service (Articles 14.1.2., 14.1.3 and 14.1.6.), we are entitled to suspend our Services in this situation.
When will Tresorit continue to provide services to Russia and Belarus?
We have suspended our services in order to be compliant with the legal provisions and due to the legal risks in the present political situation. Therefore, we will continue to provide our Services to Russia and Belarus as soon as the legal provisions / political situation make it possible.
Does the suspension apply for all Tresorit plans?
Yes, the service will be suspended for all Tresorit plans, including Tresorit Basic, our free plan. As for the paid plans, payments will also be paused.
What does it mean for using the service? Can I still access some functions?
No, as we detect that you are in Russia or Belarus, you cannot access your files or use any functionality of Tresorit.
Will my files be deleted?
No. During the suspension period we will not delete any contents of our paying customers.
