Why is Tresorit required to suspend its services in Russia and Belarus?
Following the Russia–Ukraine war, the European Union imposed sanctions restricting the provision of certain services and products to individuals, entities, and territories in Russia and Belarus. These measures are set out in Council Regulation (EU) 2022/328 (25 February 2022) and Council Regulation (EU) 2022/355 (2 March 2022).
The regulations prohibit, among other things, the provision of mass-market encryption software that could contribute to military, technological, defense, or security development in Russia or Belarus. Under Regulation (EU) 2021/821, Tresorit's service qualifies as mass-market encryption software and is therefore subject to these restrictions.
Are there any exceptions to the restrictions?
The regulations define limited exceptions based on the intended use of the service. However, as a provider of end-to-end encrypted software, Tresorit cannot verify how users would use the service. As a result, Tresorit cannot assess eligibility for these exceptions or assume the legal risk of non-compliance.
In addition, Tresorit condemns military actions that endanger civilians and violate international humanitarian law. Suspending our services helps ensure they are not used in ways that could threaten human rights.
Why has Tresorit suspended its services instead of terminating them?
EU regulations prohibit the provision of services but do not require termination of existing agreements. Under Tresorit's Terms of Service (Articles 14.1.2, 14.1.3, and 14.1.6), Tresorit is entitled to suspend services in this situation.
When will Tresorit resume services in Russia and Belarus?
Services will resume as soon as the applicable legal provisions and the political situation allow.
Does the suspension apply to all Tresorit plans?
Yes. The suspension applies to all plans, including Tresorit Basic (free). Payments for paid plans are paused during the suspension period.
What does this mean for using Tresorit?
If you are detected as being in Russia or Belarus, you cannot access your files or use any Tresorit functionality during the suspension.
What happens to stored files?
Stored files are not deleted. During the suspension period, Tresorit does not delete the content of paying customers.
